1. Who we are

Skuid, Inc. (Skuid) is a software company headquartered in Chattanooga, Tennessee that develops a robust cloud UX design-and-deploy platform allowing companies to seamlessly unite their data, apps, and processes to unleash productivity and engagement, particularly in sales organizations. Skuid was founded in 2013 on the simple belief that enterprise apps should stop forcing people to behave like machines. Instead, apps should behave more like the humans who use them, so everyone can thrive in the digital world.

With Skuid’s simple-to-use but incredibly robust cloud design-and-deploy platform, companies can seamlessly unite their data, apps, and processes to unleash productivity and engagement. 2. About this privacy policy

This policy applies to your use of Skuid web sites (“Skuid Sites”), including www.skuid.com, docs.skuid.com, community.skuid.com, and go.skuid.com and available content on subdomains of these sites. This policy also applies to your use of Skuid on AWS (Skuid Platform) and Skuid on Salesforce Services (“Skuid Services”). This policy explains who we are, what personal information we’re collecting, how we’re collecting it, how we’re going to use it, who it will be shared with, how long we’re going to keep it, how we protect it, your rights regarding your personal information, access to and use of customer data, and security.

This policy applies only to personal information we may collect from the above mentioned Skuid Sites and while using Skuid Services. This policy does not apply to the personal information that our customers store and/or access in data sources connected to Skuid Services. Please refer to the Terms of Skuid Service for information regarding the protection of personal information stored and/or accessed using Skuid Services.

Skuid participates in the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks regarding the collection, use, and retention of personal information from European Union (EU) member countries and Switzerland that may be processed using Skuid Services. We have certified with the Department of Commerce that we adhere to the Privacy Shield Principles. Skuid adheres to and supports the General Data Protection Regulation (GDPR). GDPR is a European Union (EU) regulation focused on personal information protection and privacy for EU citizens which was adopted on April 15, 2016 and became enforceable on May 25, 2018. More information on GDPR is available from the Information Commissioner’s Office, the European Commission and EUGDPR.org. Skuid has reviewed our privacy and security related processes and controls and made updates as needed, including this policy, to ensure we’re compliant with GDPR. Skuid utilizes subprocessors  in providing the Skuid Services as defined in the Skuid Subprocessor List. To help our customers prepare for GDPR, we’ve also prepared a Skuid Data Processing Addendum that can be obtained by sending a request to infosec [at] skuid dot com.

Skuid adheres to and supports the California Consumer Protection Act (CCPA). The CCPA is a state of California regulation focused on the protection of personal information and privacy for California citizens which will be adopted on January 01, 2020 and will become enforceable on July 01, 2020. Skuid has reviewed our privacy and security related processes and controls and made updates as needed, including this policy, to ensure we’re compliant with the CCPA.

3. What personal information we’re collecting

The personal information we collect may include your name, address, email address, title, company name, IP address, and internet service provider.

4. How we’re collecting personal information

Skuid may collect personal information from you in a variety of methods as described below.

4.1 Forms, surveys, emails

Forms, surveys, and emails utilized on Skuid Sites, conferences, events, marketing outreach and sales outreach mechanisms may be used to collect personal information. Forms, surveys and emails sent to individuals from the EU and Switzerland include an opt-in acknowledgement the first time we contact you that requires you to confirm that you approve and agree with us contacting you and collecting your personal information. Forms and/or code snippets incorporated into Skuid Services may also be used to obtain personal information in order to help understand and enhance your usage of Skuid Services.

4.2 Cookies

Skuid uses cookies that are session-based and persistent-based. Session-based cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. If you have chosen to identify yourself to Skuid, we use session cookies containing encrypted data to uniquely identify you. Each time you log into a Skuid Site or Service, a session cookie containing an encrypted, unique identifier that is tied to your account is placed on your browser.

These session cookies allow Skuid to uniquely identify you when you are logged into our Skuid Sites and Services and to process your online transactions and requests. Session cookies are required to use Skuid Sites and Services. Persistent-based cookies remain on your computer after you close your browser or turn off your computer. Skuid uses persistent cookies that only we can read and use to identify browsers that have previously visited Skuid Sites and Services. When you visit Skuid Sites or use Skuid Services a unique identifier is assigned you. This unique identifier is associated with a persistent cookie that Skuid places on your web browser.

Skuid is especially careful about the security and confidentiality of the data stored in persistent cookies, and Skuid does not store account numbers or passwords in persistent cookies. If you disable your web browser’s ability to accept cookies, you will be able to navigate the Skuid Sites, but you will not be able to successfully use Skuid Services. Skuid may use data from sessions and persistent cookies in combination with data about our customers and Site visitors to provide you with information about Skuid and Skuid Services, and the data stored through this method can be cleared at any time.

4.3 Web beacons

Web beacons may be used alone or in conjunction with cookies to compile information about customers’ and visitors’ usage of Skuid Sites and interaction with emails from Skuid. Web beacons are clear, electronic images that can recognize certain types of data on your computer, such as cookies, when you viewed a particular website tied to the web beacon, and a description of a website tied to the web beacon.

For example, Skuid may place web beacons in marketing emails that notify us when you click on a link in the email that directs you to one of the Skuid Sites. Skuid uses web beacons to operate and improve our websites and email communications. When you opt-in (sign up) for a newsletter or agree to receive emails, we may use a “click-through URL” to track links that you click. We may associate that data with your personal information to provide you with more focused email communications.

Skuid email communications include an unsubscribe link allowing you to stop delivery of that type of communication at any time. Skuid may use data from web beacons in combination with customer data to provide you with information about Skuid and Skuid Services.

5. How we’re going to use your personal information

When you access a Skuid Site, we collect and use data that personally identifies you to provide you with access to services we provide and our people. We collect data about you in several ways, with the purpose of operating our websites and services and providing services that you have requested, authorized, or purchased. We may also collect data about the pages you visit on our website to help us improve the site, analyze trends, and maintain the site. We merge site-visitation data with anonymous demographic data for research purposes. Skuid collects data while using certain areas of Skuid Services in order to help understand and enhance your usage of Skuid Services.

We may also use your personal information to contact you to participate in a market research survey, so that we can gauge customer satisfaction and develop better products. Skuid collects data about your visits to Skuid Sites, such as the name of your internet service provider (ISP) and the internet protocol (IP) address you use to access the internet. We use “cookie” and “web beacon” technology to enhance your experience, but we do not use those technologies to collect personal information.

6. Who your personal information will be shared with

Skuid partners with other companies to jointly offer products and services. If you purchase or specifically express interest in a jointly offered product or service from Skuid, we may share personal information about you collected in connection with your purchase or expression of interest with our joint promotion partner(s). Skuid does not control our business partners’ use of the personal information we collect about Skuid customers; however, business partners are required to maintain the confidentiality of any such personal information and to adhere to practices substantially similar to this policy.

Skuid may share your personal information with third party companies and partners we jointly offer products and services with as required for your use of Skuid services. We may also provide selected personal information to companies who provide services such as website hosting, answering customer questions about products and services, and sending personal information about our products, special offers, and other new services. We will only provide those companies the personal information they need to deliver the service. They are required to maintain the confidentiality of the personal information, adhere to this policy, and are prohibited from using that personal information for any other purpose. Skuid does not share, sell, rent, or trade any personal information provided with third parties for their promotional purposes.

Skuid uses third party analytics services to help understand and enhance your usage of Skuid Services. For example, we may provide your personal information (first name, last name and email address) to third parties and utilize these third parties to collect data for analytics purposes when you use Skuid Services. As a data processor acting on our behalf, third parties analyze your use of Skuid Services and track our relationship by way of cookies and similar technologies so that we can improve our services to you. We may also use these third parties as a medium for communications, either through email, or through messages within our services.

Skuid uses a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use billing personal information except for the sole purpose of credit card processing on Skuid’s behalf.

Skuid reserves the right to use or disclose personal information provided if required by law or if Skuid reasonably believes that the use or disclosure is necessary to protect Skuid’s rights and/or to comply with a judicial proceeding, court order, or legal process.

7. How long we’re going to keep your personal information

We review our retention periods for personal information on a regular basis. We are legally required to hold some types of personal information to fulfill our statutory obligations. We also reserve the right to retain personal information as long as we believe there is a legitimate business interest for contacting you regarding Skuid products and services. We will hold your personal information on our systems for as long as is necessary for the relevant activity or as long as is set out in any relevant contract or agreement you hold with us.

8. How we protect your personal information

These privacy guidelines are communicated to every Skuid employee. Skuid does not knowingly solicit personal information from children or send them requests for personal information. Although Skuid takes significant precautions to protect your security, we urge you to take every precaution to protect your personal information when you are on the Internet. Change your passwords often, use a combination of letters and numbers, and make sure you use a secure browser.

If we are going to use your personal information differently from that stated at the time of collection, Skuid will attempt to contact you via email using the most recent personal information we have. If you have not given us permission to communicate with you, you will not be contacted, nor will we use your personal information in a new manner. Skuid reserves the right to change this policy. Skuid will provide notification of the material changes to this policy through the Skuid Sites.

9 Your rights regarding your personal information

9.1 Right to withdraw consent

All Skuid emails sent to you initially require an opt-in acknowledgement. You may unsubscribe to email communications from Skuid by clicking the Unsubscribe link on any communication sent to you from Skuid. You may also change your opt-in preference by contacting marketing [at] skuid dot com.

9.2 Right to correct and change your personal information

Customers and Skuid Site visitors may update or change their registration personal information and opt-in preference by contacting marketing [at] skuid dot com. To update or change your billing personal information, please send an email to billing [at] skuid dot com. To discontinue your account, please email sales [at] skuid dot com. All requests will be handled in a timely manner.

9.3 Right to access personal information and personal information portability

Upon request, Skuid will disclose to you what personal information we have about you, the sources from which the personal information was collected, the commercial purpose for collecting or selling personal information, the categories of third parties with whom we share or disclose personal information and provide you with copies of your personal information in our possession within 45 days of the request in a readily useable format.

9.4 Right to be forgotten and personal information erasure

Upon request, Skuid will delete your personal information in our possession and direct third parties we’ve shared your personal information with to do the same.

9.5 Right to opt-out

If you want to opt out of the “sale” of your personal information (as defined in the California Consumer Privacy Act (CCPA)) or the General Data Protection Regulation (GDPR), please email us at Infosec [at] Skuid dot com with the subject: “Do Not Sell My Personal Information” and we will honor your request.

9.6 Right to protection for minors

Skuid does not “sell” (as defined in the CCPA) personal information of children under the age of 16.

9.7 Right to contest profiling

You have the right to contest, object to, and request explanation for automated decisions or decisions made by algorithms that may profile you.

9.8 Right to lodge a complaint with a supervisory authority

If you feel that your personal information is not being used in compliance with this policy, please contact infosec [at] skuid dot com and we will review and assist you with your concerns. You also have the right to lodge a complaint with a supervisory authority in the Member State of your habitual residence, place of work, or place of the alleged infringement if you believe that the processing of your personal information is not in compliance with this policy.

9.9 Right to non-discrimination

Skuid will not discriminate against you such as by charging more for services or degrading quality of services you receive if you exercise any of your rights as described in this policy and the GDPR and CCPA regulations.

10. Access to and use of customer data

For the purpose of improving Skuid Services, Skuid may anonymize and analyze usage patterns within the software. This data is not shared with third parties. Skuid will not review, share, distribute, or reference any customer data except as provided in the Terms of Skuid Service or as may be required by law. In accordance with the Terms of Skuid Service, Skuid may access customer data only if authorized by the customer. In the event access is authorized, Skuid will utilize modern, standards-compliant web browsers utilizing Hyper Text Transfer Protocol Secure / Transport Layer Security (HTTPS/TLS) to protect customer data using both server authentication and data encryption. These technologies help ensure that customer data is safe, secure and only available to authorized users.

11. Security

Skuid and its partners have implemented a variety of advanced security protocols and processes on the Skuid Sites and Services in a secure environment that utilizes firewalls, intrusion detection systems, and other advanced technology to prevent interference or access from outside intruders. Skuid also offers enhanced security features within the Skuid Services that permit customers to configure security settings to the level they deem necessary. Customers are responsible for maintaining the security and confidentiality of their usernames and passwords. 12 Changes to this policy

This policy is subject to change at any time. We encourage you to review this policy regularly for any changes. Skuid welcomes your comments regarding this policy statement at any time.
